1. Order Placement
All products and services provided by Flexpipe Australia are supplied according to these Terms and Conditions. Orders may be placed electronically, verbally, or via written communication. Acceptance of your order is expressly subject to your agreement to these Terms. Any variations proposed by you are invalid unless agreed to in writing by Flexpipe Australia.
2. Pricing and Delivery
Prices are in Australian Dollars (AUD) and exclusive of GST unless otherwise stated. Delivery charges may apply and will be outlined at the time of purchase. Flexpipe Australia reserves the right to amend prices without prior notice. Risk in goods passes to you upon dispatch from our warehouse. Flexpipe Australia will not be liable for delays in delivery due to factors beyond our control (e.g., weather events, supply chain disruptions).
3. Shipment, Changes, and Cancellations
Custom products (items made to order or modified) cannot be changed or cancelled once manufacturing has commenced. For standard (stock) products, you may request changes or cancellations if the request is made at least ten (10) business days before the scheduled dispatch date and provided the goods have not already been shipped.
4. Product Images and Description
While we aim to ensure our product images and descriptions are accurate, minor differences may occur. If you believe a delivered product materially differs from its description, you may request a return within thirty (30) days of receipt under our Return Policy.
5. Acceptance of Goods
You are deemed to have accepted products unless you notify us in writing of any defects or errors within thirty (30) days of receipt. Please inspect all deliveries promptly. Claims for damages caused during transit must be directed to the carrier.
6. Intellectual Property
All intellectual property provided (including photographs, logos, catalogues, drawings, and website content) remains the property of Flexpipe Australia or its licensors. You must not use our intellectual property without our written consent, except as necessary for normal business dealings with Flexpipe Australia.
7. Returns Policy
Returns are accepted in accordance with Australian Consumer Law. You must notify us within thirty (30) days of delivery if you wish to return an item. Returns may incur a restocking fee unless otherwise required by law. Goods must be unused, in original packaging, and accompanied by proof of purchase. Custom products are not eligible for return unless they are faulty.
8. Taxes
All prices include Goods and Services Tax (GST) unless stated otherwise. Any other applicable taxes, duties, or government charges are your responsibility.
9. Payment and Credit Terms
Payment is required prior to dispatch unless a credit account has been established and maintained in good standing. Flexpipe Australia reserves the right to charge interest on overdue amounts at a rate of 1.5% per month (18% per annum) and to recover all costs associated with the collection of overdue payments, including legal fees.
10. Quality Guarantee
Flexpipe Australia warrants that its products will be free from defects in materials and workmanship for a period of one (1) year from the date of shipment. This warranty is limited to repair, replacement, or refund, at Flexpipe Australia’s discretion. This warranty does not apply to misuse, improper installation, or modifications made by the customer. Flexpipe Australia disclaims all other warranties, express or implied, except those that cannot be excluded under Australian law. Under the Australian Consumer Law, you are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.
11. Indemnity
You agree to indemnify Flexpipe Australia against any claims, loss, or damage arising from your misuse of our products, except to the extent caused by our negligence or breach of statutory guarantees.
12. Force Majeure
Flexpipe Australia is not liable for failure to perform any obligation if the failure is due to events beyond its reasonable control, including but not limited to natural disasters, pandemics, government restrictions, strikes, transport disruptions, or supply shortages.
13. Limitation of Liability
To the extent permitted by law, Flexpipe Australia excludes all liability for indirect or consequential losses. Where liability cannot be excluded, Flexpipe Australia limits its liability to, at its discretion, replacement of the goods, repair of the goods, or payment of the cost of replacing or repairing the goods.
14. Governing Law
These Terms and Conditions are governed by the laws of the State of Victoria, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Victoria.
15. Changes to Terms
Flexpipe Australia may amend these Terms and Conditions at any time. Updated terms will be effective immediately upon publication on our website.
